Zynga sued Vostu in federal court for copyright infringement, alleging that several of Vostu's social games copied Zynga's games hosted on platforms like Facebook. After Zynga obtained a broad preliminary injunction against Vostu in parallel Brazilian proceedings, Vostu sought a U.S. anti-suit injunction to bar enforcement of the Brazilian order while the domestic case proceeded. Applying the Ninth Circuit's anti-suit injunction factors, the court found that the parties and issues in the two actions were not identical in a dispositive way, that comity concerns were significant, and that no strong U.S. policy was frustrated by allowing the foreign litigation to continue. Accordingly, the court dissolved the temporary restraining order it had previously issued and denied Vostu's request for a preliminary injunction.
