The case concerned New York’s enforcement of ticket resale regulations under Arts and Cultural Affairs Law article 25 against an out-of-state corporation and its president. The Attorney General documented repeated sales by The Concert Connection, a Connecticut firm, of tickets to New York events at prices exceeding the statutory maximum premium, using New York advertising and telephone numbers. The court held that personal jurisdiction existed under CPLR 302(a)(1) because the defendants had contracted to supply tickets in New York and had purposefully availed themselves of the forum, and that the regulations did not violate the Commerce Clause. It further ruled that the corporate officer could be held individually liable for knowingly participating in the illegal transactions. The Appellate Division therefore affirmed the grant of an injunction, restitution, damages, and costs.
