DOJ Drops Charges Against Olympian Just As New Documents Emerge

The Justice Department dropped felony charges against former Olympian David Hearn on Friday. This was not a quiet dismissal. It came after new facts showed the damage to the Lincoln Memorial Reflecting Pool was not his fault.
Hearn, a 67-year-old canoe racer, faced up to ten years in prison. Now, those charges are gone. The Washington Times reported the dismissal in a court filing on July 31.
Hearn was arrested on June 19 and charged with property destruction. Prosecutors claimed he tore up the pool liner. But the story changed fast.
After Hearn was indicted, the Department of the Interior gave prosecutors more files. These papers showed the damage in June 2026 was from flawed installation by a contractor named ‘Atlantic Industrial Coatings’.
The rush to finish before the America 250 celebration caused the mess. A defense expert inspected the drained pool on July 17. He “immediately noted extensive damage,” according to court records.
Subsequent investigation uncovered repeated failures of the lining during the installation process. An NPS engineer sent an email on June 11, 2026, stating the cause was “overspray.” The engineer also wrote that the peeling would “not impact the strength of the liner.” A July 20, 2026, inspection by contractors confirmed the error. It was not a crime. It was a botched job.
President Trump is furious about the reversal. “I disagree 100% with Jeanine Pirro, the U.S. Attorney for the District of Columbia, on the Reflecting Pool,” he said. Pirro asserted that a park employee witnessed Hearn removing material.
“I don’t know what she was thinking?” Trump posted to Truth Social. “There may have been some contractor difficulty, but the major damage was caused by VANDALS!”
Now, the government admits the facts do not support a criminal case. A filing asserts that given all of this newly discovered information.
It is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt. Breitbart reported that Pirro herself requested all charges be dropped. Four people were arrested in total, but Hearn was the only one facing felony time.
